Terms and Conditions of the Online Booking System of The Living Museum of Gingerbreads

 

1. Definitions

 

In these Terms and Conditions the following words shall have the meaning set out below:

1. Museum – refers to The Living Museum of Gingerbreads located at no. 9, Rabianska street, 87-100 Torun, run by TO-TUR Torunska Turystyka, no. 9. Rabianska street, 87-100 Torun.

2. The Show – or the Tour – refers to an interactive show that takes place on the first floor of our venue and the show and exhibition of working of vintage bakery industry equipment that take place on the second floor of our venue.

3. Individual visitors – a person or a number of persons (adults or children or both mixed) at a maximum number of 14 persons.

4. Organized group of tourists – group of persons (adults or children or both mixed) at a number of at least 15 persons and maximum of 60. This number, though, does not include caring staff or tour guides.

5. School trips and tours – Early Learning School and Infant School pupils as well as School pupils and students booking directly with us without any third parties.

6. Customers – organized tourist group or individual tourist or tourists who purchase tickets.

7. Visitors – individual tourists, organized groups and school groups members.

8. System – online booking system of The Living Museum of Gingerbread, available on www.muzeumpiernika.pl.

9. Booking price – total price, number of persons multiplied by ticket price.

10. The Ticket – the slip confirming a contract made between the Customers and the Museum. Tickets entitle customers to attend the Show. Whenever singular of 'ticket' is used here it always refers to a number of visitors the booking is made for.

11. T&Cs – abbreviation referring to the Terms and Conditions of the Online booking system of The Living Museum of Gingerbreads, located at no.9 Rabianska Str, Torun 87-100.

 

 

General Terms

1. These T&Cs state principles of booking and purchasing tickets for the Shows run by the Museum . In addition these T&Cs specify ways of execution of a contract between the Museum and the Customers.

2. The system is an online service enabling booking and purchasing tickets for the Shows.

3. System is a property of Elzbieta Olszewska representing TO-TUR located at no. 9, Rabianska Street., registered NIP (Tax payee number):956-100-80-09, REGON(registration number): 870-613588, e-mail address: muzeumpiernika@muzeumpiernika.pl called thereafter the Museum as set in cause 1 of paragraph 1 of these T&Cs.

4.Minimal technical requirements for proper usage of the system are as follows: access to the Internet and:

a. An operating system – Miscrosoft Windows, Linux, OS X

b. An internet browser – Firefox, Chrome, Opera or Internet Explorer (updated).

5.Should minimal technical requirements be not met a proper working of system may be affected and Customers may not be able to purchase tickets. Confidential information safety may be affected, too. Any deliberate or non-deliberate usage of the system that is not in accordance with its purpose is a breach of these T&Cs.

Business hours

1. Schedule and timetables of the Shows for the individual tourists as well as organized tours and trips participants are available on our website www.muzeumpiernika.pl

2. Shows start at every full hour (first admission at 10 am, the last one at 5 pm.)

3. We can host 75 persons per one Show at a maximum

4. Should majority of visitors be individual tourists then the number of visitors we can host is 60 at a maximum.

5. Should majority of visitors be organized groups participants then maximum number of visitors is 75.

6. Average duration of the Show is estimated at 75 minutes.

7. We are entitled to change dates and times of the Shows or impose temporal exclusion of parts of the Museum if this is reasonably justified.

 

The Online Booking System

1. The online booking and purchase system is a free of charge service that enables booking and purchasing tickets for individual tourists and organized tourist groups.

2. To use the system you are required to:

a). accept these T&Cs which is then a legal obligation between the Customers and the Museum.

b). following procedures of purchasing which are:

- Providing personal information needed in order to make booking

- selecting dates, time, number of persons and type of tickets

- double-checking if information provided is correct

- accepting these T&Cs and acting accordingly to these.

- paying and printing out tickets or producing them on mobile devices at the Museum upon arrival

3. A contract is made by selecting date and time and a number of tickets and their types by the Customers. Also, to consider contract made a payment is required (full price in case of the individual tourists, advance payment in case of organized groups of tourists)

4. In accordance with 26.7.2010 Ministry of Finance Act of Law regarding taxation of on-line sells Customers do not need to be given receipts.

5. We are entitled to terminate tickets on-line sale at any time due to any justified reason.

6. We may cancel any bookings should no full information be provided or should information provided be false.

7. We shall take no responsibility for outcomes of providing false information or incorrect information which may lead to data ill transmission while purchasing tickets which ultimately may disable customers from purchasing tickets.

8. Discount tickets available to children, pupils, students under 26 years of age, persons with disabilities over 26. You must have on you your ID or any document enabling you to claim discount tickets and be ready to produce it upon arrival.

9.Free of charge admission available to children under 3 years of age and persons with disabilities under 26 years of age.

10. The elderly visitors and pensioners are entitled to discount tickets. Details to be found on our website: www.muzeumpiernika.pl

11. Over usual business hours different prices apply.

12. Table of tickets and prices to be found on www.muzeumpiernika.pl Prices are given in PLN (polish zlotys)

13. Every ticket may be used only once.

14. Tickets may be returned according to these T&Cs. The 30.5.2014 Consumer Law Act does not apply here. This does not affect your statutory rights.

You can also claim money return or ticket change only if the Show is cancelled due to any reason.

This is in accordance with paragraph 8 of these T&Cs and it does not affect your statutory rights either.

15. Should the Show be canceled or should date and time be changed The Museum is to inform customers promptly. Customers may then claim money return or select new date and time as they wish. To claim money return Customers should send written request to the Museum to muzeumpiernika@muzeumpiernika.pl. Money is to be repaid immediately (bank account transfer or cash). This process is to take no longer than 14 working days (counting from a day full information from a customer is received).

 

Individual tourist bookings

1. Individual tourists (customers) may book tickets for up to 14 visitors.

2.Individual customers are obliged to make payments via PayU and to print out tickets or be able to produce them on a mobile device.

3. Shows translated to English start daily at 1 p.m. and at 4 p.m.

4. Customers may require translation to German. To do so, phone us on +48 56 663 66 17

5.We shall be entitled to join individual tourist to any organized group of visitors and the other way round up to the total number of 60 visitors.

6. Exclusive shows are priced individually (but not less than 500 pln) and are subject to availability.

Organized groups of tourists

 

1.Customers can make a one-time booking for at least 15 persons up to 60 persons.

2.We shall be entitled to to join other individual or organized groups visitors up to number of 75 persons.

3. Exclusive shows are priced individually (but not less than 500 pln) and are subject to availability.

4. To every 15 persons with discount tickets one free of charge ticket for guide/care staff is allocated

5. Should this be group of persons with disabilities free of charge tickets for care staff or guides are allocated according to an Act of Law regarding this subject.

6. Customers may select tour language (German, English, Polish). Shows can be run in two different languages at the same time at a maximum.

7. Having made a booking customers are obliged to make an advance payment (at a rate of at least 150 pln) within 7 working days. Payments are to be made to our account: Millenium Bank (Torun Branch) account number is: 27116022020000000291518783

8. Should customers fail to make an advance payment within 7 working days we shall be entitled to cancel your booking.

9. Customers are obliged to pay money due at the ticket office upon arrival.

10. Whenever money paid in as an advance payment exceeds total price discrepancy is to be paid out to a customer at the ticket office promptly upon their arrival.

11.Customer may pay in the total price straight away. Payments are to be made to our account, details: Millenium Bank (Torun Branch) account number is: 27116022020000000291518783

Once the total price is paid customers receive their tickets via an e-mail.

12. If selected tour is due to take part in a period of less than 7 working days starting from day of booking then customers are to pay the full price at the ticket office upon arrival.

13.If selected tour is due to take place in less than 30 days from booking day then changing of number of visitors or canceling the booking altogether is not accepted.

14.Customers without an advance payment made are obliged to arrive at least 10 minutes before the show is due to start. Otherwise tickets booked will be sold out as walk-up tickets.

 

7.School tours bookings

 

1. Customers can make a booking for at least 15 persons up to 60.

2. One free of charge ticket is allocated to every 15 members of a school group.

3. In case of Early Learning School or Infant School trips one free of charge ticket for care staff is allocated to every 10 pupils.

4. Should there be members with disabilities within a group of schoolchildren or pupils free of charge tickets are allocated accordingly to a relevant Act of Law.

5. Should this be group of school children with all its members having disabilities then Customer is obliged to pay in 100 pln advance payment within 7 working days from booking day. 6. Customers may select a tour language (English, German, Polish). Two languages may be spoken at once at a maximum.

8 Booking change or cancellation (Individual visitors)

1. Individual visitors can change their number or cancel the booking altogether up to 3 days prior to the day the show is due.

2. Information on changing of number of visitors or canceling should be provided up to 3 days prior to the day the show is due to take place via an-email or phone call. Phone us on +48 56 663 66 17.

3. Providing information within 3 days will ensure that money is repaid to Customers.

4. If the time slot of 3 days is exceeded then money may not be returned.

5. Customers may increase number of visitors – this is subject to availability.

6. Should booking be made in a period of time shorter than 3 days before the tour is due to take place then neither cancellation nor change of number of visitors are accepted and money is not to be returned.

 

9.Booking change or cancellation (organized groups and school children)

 

1. For your convenience we do accept booking cancellation or change of number of visitors up to 30 days prior to the day selected tour is due to take place.

2. In these cases an advance payment is paid out to customers promptly.

3.Information on cancellation or change of number of visitors is to be provided via an e-mail muzeumpiernika@muzeumpiernika.pl. Customers should provide account details so that transfers could be made at the soonest possibility.

4. Increase of number of visitors is subject to availability.

5. No booking change or cancellation in period of time shorter than 30 days is accepted.

6. Should customers fail to provide information on cancellation or on change of number of visitors then customers are obliged to pay total price nonetheless and this is to be paid within 7 days counting from the booking day. 10. Personal and confidential information safety

 

1. 1997 On-line Service Act of Law regarding personal information applies here unless 2002 On-line Service Act of Law states otherwise.

2.We do collect and process personal information to the point it is required to fulfill the contract.

3. Data admin is Elzbieta Olszewska, registered as TO-TUR, located at no. 9., Rabianska Str, Torun 87-100.

4. While making a booking via on-line system Customers give a consent in terms of data processing. Not providing required information will prevent a contract from being made.

5. Customers are given full access to their personal data in order to change it or up-date it. 1997 Personal and Confidential Data Act of Law applies here.

 

11. Complaints, Cancellation Rights and Refund Policies.

 

1. Customers are entitled to make complaints at any time via an e-mail muzeumpiernika@muzeumpiernika.pl, or by postal letter or in person at the ticket office.

2. Claims are to be processed and answer within 30 days and are replied either via an e-mail or postal letters.

3. We do accept third parties' presence in case of any disagreement that may occur.

 

12. Ordeal Terms and Conditions

 

1. Latecomers: customers arriving 5 minutes or more after the show had started may not be let in. Refusal of admission is due to an interactive and theatrical character of the show.

2. Visitors under influence of an alcohol or other substances or behaving in a way that may breach the order of the show or those who may impose any risk on our collections or those who show any antisocial behaviour will be refused admission.

3. Those who disturb the order of the show may be required to leave the venue.

4. We do not take responsibility for children left unattended.

5. If customers order diplomas for each participant full list of names must be provided at least 14 days before the day the show is due to take place.

6. Phone calls are prohibited at all times during the show.

13. Changes to these T&Cs

 

1.Customers have access to these T&Cs at any time by clicking the link on our website www.muzeumpiernika.pl

2. It is permitted to download these T&Cs to your hard drive or any drive or to print it out as a point of reference.

3. We are entitled to change and up-date these T&Cs. Any changes will be published as an up-dated T&Cs available on our website.

4. Customers should familiarize themselves promptly with any changes to these T&Cs as making booking with us equals accepting T&Cs.

5. Regardless any reasons that may cause change to occur to these T&Cs up-dated new T&Cs will be produced to customers while logging in.

6. Should you not accept these T&Cs then you should not continue logging in. You should then inform us if you do not wish accepting these T&Cs. This will disable you from further booking.

 

14. Final statements

 

1. Governing Law. These T&Cs and any contract concluded incorporating these T&Cs shall be governed by polish law.

2. Information regarding any changes to these T&Cs and up-dated version of these are to be sent to an e-mail address provided by a customer.

3. All bookings are to be in accordance with the version of T&Cs that was in place at a time of making these bookings.

4. Any disagreement between the Museum and a customer (whenever the latter is considered to be a consumer too) is to be dealt with in accordance with a cause no. 221 of a Civic Law Code and shall be looked after by a Court of Law regarding governing law.

5. Should a customer be not considered a consumer the same acts of law must be complied with.

6. Customers are entitled to have access to these T&Cs at any time by clicking the link on our website www.muzeumpiernika.pl

7. It is permitted to download these T&Cs to your hard drive or any drive or to print it out as a point of reference.

8.Should any disagreement that is not covered by these T&Cs occur then the acts of law of a governing law apply.

9. This does not affect your statutory rights. Should these T&Cs contradict governing law than the governing law applies.

10. These T&Cs are effective from 1 January 2016.

11. Purchasing tickets via Booking System equals accepting our T&Cs.

12. In case of Tour Operators who have signed a contract with the Museum these T&Cs form an appendix to a contract and purchasing tickets equals accepting our T&Cs.
